Our history…
Harvest Pointe South (HPS) subdivision was started in 2003 when Bielinski Builders signed a Development Agreement with the City of Elkhorn. The Harvest Pointe South Homeowners Association, Inc. was created on March 2, 2004 when Articles of Incorporation were filed with the State of Wisconsin’s Department of Financial Institutions. Each year the Association is required to file a report with the State to keep its status as an active corporation in place. The Association has a set of Bylaws that dictates how the Association is to be governed. The Bylaws were last amended in 2022.
Each of the 72 lots within the subdivision are encumbered with a Declaration of Covenants, Conditions and Restrictions (DCCR) created by Bielinski Builders and filed with the county as a restriction on the deeds. The DCCR was amended twice by Bielinski Development, Inc. while they had control of the Board and/or owned in excess off 70% of the lots. Each lot owner is automatically a member of the Association under the terms of the DCCR and is required to comply with all terms of the DCCR and any Rules established by the Board of Directors.
On January 26, 2021, Bielinski formally turned control of the Homeowners Association over to the property owners. The members at this Annual meeting elected three members of the Association to serve on the Board of Directors.
At the 2022 Annual Meeting, the membership approved changes to the Bylaws proposed by the Board of Directors. Additional directors were also elected at that meeting bringing the Board to five members, the maximum size under the revised Bylaws.
